§ 1 Scope and Provider
These Terms govern the use of the Claimscan SaaS platform provided by Piyal Ranasinghe, Querstraße 6, 90489 Nürnberg, Germany ("Provider").
Claimscan is offered exclusively to businesses (B2B). Use by consumers within the meaning of § 13 BGB is not intended.
Subscriptions are sold via our authorised reseller Dodo Payments (Merchant of Record). These Terms govern the relationship between the Provider and the Customer regarding the provision and use of the Claimscan software (license and service agreement). Billing- and payment-related terms (in particular payment processing, invoicing, tax handling, refunds, chargebacks) are governed by Dodo Payments' terms and constitute a direct contractual relationship between the Customer and Dodo Payments.
§ 2 Services
The Provider offers a forensic image-analysis platform. Analysis returns probabilistic findings and a PDF report indicating authenticity or manipulation likelihood.
Important: Results are decision aids, not judicial expert opinions or automatic decisions. The Provider makes no determination about the legitimacy of any individual return claim.
§ 3 Registration and Contract
The contract for the use of the software (license and service agreement) is concluded between the Customer and the Provider upon account registration and email verification. The Free plan is available immediately.
For paid plans, an additional subscription contract is concluded between the Customer and Dodo Payments (Merchant of Record) upon successful payment processing through Dodo Payments. Dodo Payments issues the invoice in its own name. The Provider activates the paid feature set immediately after successful payment.
§ 4 Customer Obligations
- Lawful use only, no copyright infringement.
- No illicit content (e.g. CSAM, unlawfully obtained personal images). We reserve the right to suspend accounts and report to authorities where applicable.
- GDPR compliance when uploading third-party personal data. A DPA is available free of charge.
- Current contact details in the account.
§ 5 Pricing and Billing
Current pricing is published on claimscan.io. Billing is charged in advance (monthly or yearly) by Dodo Payments as Merchant of Record. All listed prices are exclusive of any applicable sales / value-added tax (e.g. German VAT, EU OSS VAT, US Sales Tax, GST); the applicable tax is calculated, withheld and itemised on the invoice by Dodo Payments according to the regulations of the Customer's place of business. Refunds, chargebacks and tax corrections are likewise handled by Dodo Payments.
§ 5 Free and Solo Plans
The free Free plan includes 10 image checks per calendar month with an additional cap of at most 2 checks per calendar day (Europe/Berlin time zone). There is no entitlement to email support; help is provided exclusively through the help center. The daily limit resets at 00:00 Central European Time, and the monthly quota resets on the 1st of each month.
The Solo plan costs €9.99 per month (incl. VAT per § 5) and includes 40 image checks per calendar month with no daily limit. Unused checks expire at the end of the month and do not roll over. Once the monthly limit is reached, additional checks are blocked technically until the start of the next calendar month; upgrading to a higher plan lifts the block immediately. Solo is self-service; support is provided exclusively through the help center.
§ 5a Early Bird Plan
The “Early Bird” plan is limited to 50 customers and grants unlimited use of Claimscan within the fair-use policy defined in § 5b. The price of €19/month (incl. VAT per § 5) is guaranteed for 12 months from the booking date.
After the 12-month period the subscription switches automatically to the Starter plan (€29/month, 200 checks/month). Customers are notified by email 30 and 7 days before the switch. Cancellation is possible at any time, effective end of month, through the billing portal.
§ 5b Fair-Use Policy (Early Bird)
“Unlimited” does not mean abuse-friendly. Early Bird customers may run 5,000 image checks per calendar month. We notify by email when usage reaches 80 % of the limit (4,000 checks) and when the limit is reached. Starting with the 6,001st check in the current calendar month, additional checks are blocked technically until the end of the month; the quota resets automatically at the start of the next calendar month. Upgrading to a Business or Enterprise plan lifts the block immediately.
§ 5c Training Data (opt-in)
By voluntarily consenting to the use of anonymised analysis data (toggle under “Preferences” in your account) customers help us improve the detection algorithms. Only structured feature vectors are stored (verdict, finding categories, image resolution, file format, industry, perceptual hash). No original images, no EXIF or GPS data, no customer or personal information is retained. Consent can be withdrawn at any time with effect for the future.
§ 6 Term and Termination
Subscriptions auto-renew unless cancelled before the end of the billing period. Cancellation at any time via the billing portal. Free accounts may be deleted at any time.
§ 7 Liability
The Provider is fully liable for intent and gross negligence, and for damages to life, body, or health. For simple negligence, liability is limited to breach of material contractual duties and foreseeable typical damages.
The Provider assumes no liability for decisions (in particular the rejection of return claims) made by the Customer based on Claimscan results. Claimscan is a decision-support tool; final judgment rests with the Customer.
§ 8 Availability
Target availability is 99 %/year, excluding scheduled maintenance (announced in advance) and unavoidable third-party outages. Specific SLAs apply only to Enterprise plans.
§ 9 Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Nuremberg where the Customer is a merchant, legal entity under public law, or special fund under public law.
Should individual provisions be invalid, the remainder of the contract remains in force.
